Terms & Conditions

These Terms & Conditions apply to all services provided by derm360º® (“derm360º”, “we”, “us” or “our”).

By booking an appointment, purchasing a service, submitting samples for laboratory testing or engaging with our services, you confirm that you have read, understood and agree to these Terms & Conditions.

These Terms & Conditions should be read alongside any service-specific information, consultation forms, consent forms, aftercare instructions and our Privacy Policy.

Nothing within these Terms & Conditions affects your statutory rights under applicable UK consumer law.

1. General

1.1 Professional Scope

derm360º provides personalised skin health and wellness services informed by biochemistry, nutritional science, scientific research, client history, symptoms, lifestyle factors and, where applicable, laboratory testing.

Our services are educational and wellness-focused and are intended to support skin health and general wellbeing.

derm360º does not provide medical diagnosis. Our services are not a substitute for assessment, diagnosis or treatment from a GP, dermatologist or other appropriately qualified healthcare professional. Where appropriate, we may recommend that you seek medical advice or further investigation from another healthcare professional.

1.2 Client Responsibility

You are responsible for providing complete, accurate and up-to-date information relevant to your consultation or service.

This includes, where applicable:

  • medical history;

  • current and previous medications;

  • supplements;

  • allergies and intolerances;

  • pregnancy or breastfeeding status;

  • previous or current treatments;

  • relevant diagnoses;

  • significant changes in your health or circumstances; and

  • any other information reasonably requested by derm360º.

Failure to provide relevant information may affect the suitability, safety or accuracy of recommendations.

You must notify derm360º of any relevant change in your circumstances during an active plan.

1.3 Right to Refuse or Terminate Services

derm360º reserves the right to refuse, postpone or terminate a service where reasonably necessary, including where:

  • required information has not been provided or is materially inaccurate;

  • relevant medical or health information has been withheld;

  • the service is not appropriate or falls outside our professional scope or insurance requirements;

  • a client is medically unsuitable for the service;

  • a client attends an appointment intoxicated or otherwise unfit to participate safely;

  • required consent, identification or documentation has not been provided;

  • a client repeatedly fails to follow relevant instructions;

  • abusive, threatening, aggressive or inappropriate behaviour occurs; or

  • continuing the service would create a safety, professional or insurance concern.

Where an appointment cannot proceed because of information or circumstances that were the client's responsibility to disclose or manage, applicable cancellation or service fees may apply.

1.4 Changes to Services

We reserve the right to make reasonable changes to our services, treatment protocols, testing options, appointment structures and pricing.

The terms and pricing applicable to your booking will generally be those in place at the time of booking, unless otherwise required by law.

1.5 Force Majeure

We may need to postpone or rearrange an appointment because of circumstances outside our reasonable control.

This may include illness, laboratory delays, travel disruption, power or internet failure, natural disasters, technical issues or other unforeseen circumstances.

 

Where this occurs, we will make reasonable efforts to notify you and rearrange the service as soon as practicable.

2. Bookings, Payments & Cancellations

2.1 Formation of Contract

A contract between you and derm360º is formed when you complete a booking and payment has been successfully received, or when derm360º otherwise confirms your booking in writing.

By completing a booking, you confirm that you have read and accepted these Terms & Conditions and any service-specific terms provided at the time of booking.

2.2 Booking Confirmation

A booking is only considered confirmed once the required payment has been successfully received and confirmation has been issued.

 

derm360º reserves the right to decline or cancel a booking where payment has not been received or where the service is not suitable.

 
2.3 Personal Bookings

Bookings are personal to the individual named on the booking and may not be transferred to another person unless expressly agreed by derm360º.

2.4 Payment

Payment must be made in accordance with the payment terms displayed at the time of booking.

We accept the payment methods made available by derm360º, which may include card payment, Stripe and other approved payment methods.

 

Services will not be provided where required payment has not been received.

 

Future bookings may be declined until outstanding balances have been cleared.

2.5 Deposits, Retainers & Prepayments

Unless otherwise stated:

  • deposits, retainers and prepayments are non-transferable and non-refundable, except where required by law or expressly stated otherwise;

  • payments cannot be transferred to another person;

  • payments cannot be transferred between unrelated services unless agreed by derm360º;

  • deposits and retainers are valid for six months from the date of payment.

If a service has not been booked within six months, the payment may expire and a new payment may be required.

Nothing within this section affects statutory rights that cannot legally be excluded.

2.6 Rescheduling

Appointments may be rescheduled once without charge when at least 48 hours' notice is provided.

Where less than 48 hours' notice is provided, a 50% charge of the booked service value will apply.

Additional rescheduling may incur further fees at derm360º's discretion.

The 48-hour period is calculated from the scheduled appointment start time.

2.7 Cancellations

Cancellations made 48 hours or more before the scheduled appointment will not incur a cancellation charge, subject to any service-specific payment terms.

Cancellations made with less than 48 hours' notice require payment of 50% of the booked service value.

Where a deposit or prepayment has already been made, this will be applied towards the applicable 50% cancellation charge. Where the amount already paid is less than 50% of the booked service value, the remaining amount may be charged.

2.8 Missed Appointments & Late Arrival

If you do not attend your appointment without prior notice, the appointment will be treated as a no-show and 100% of the booked service value will be charged.

A 15-minute grace period applies to appointments.

Where you arrive more than 15 minutes late and there is insufficient time to safely or appropriately provide the service, the appointment may be treated as a missed appointment and the full service value may be charged.

Partial attendance does not automatically reduce the amount payable.

2.6 Non-Payment

Where an outstanding payment is not received by the required deadline, derm360º may cancel the relevant appointment or service.

Future bookings will be declined until outstanding balances have been cleared.

3. 360º Consultations & Laboratory Testing

360º consultations are specialist, in-depth services that may involve advance preparation, laboratory testing, review of results and preparation of personalised recommendations before the scheduled consultation.

 

For this reason, 360º consultations are subject to the specific terms below and are non-refundable.

3.1 360º Consultation Bookings

Once a 360º consultation has been booked and payment has been received, the consultation is non-refundable.

This applies where a client subsequently changes their mind, decides not to proceed, is unable to complete the required testing or is unable to attend the consultation.

Where a client is unable to attend, the consultation may be rescheduled in accordance with Section 3.2.

This does not affect any statutory consumer rights that cannot legally be excluded.

3.2 Rescheduling a 360º Consultation

A 360º consultation may be rescheduled once, provided at least 48 hours' notice is given.

Where less than 48 hours' notice is provided, a £50 rescheduling fee applies.

The 48-hour period is calculated from the scheduled consultation start time.

3.3 Missed 360º Consultations

If you do not attend your scheduled 360º consultation, the consultation is considered missed and no refund or transfer will be provided.

 

A new consultation must be booked and paid for if you wish to proceed.

3.4 Laboratory Testing & Sample Submission

Where laboratory testing forms part of your 360º service, you are responsible for completing the required testing within the timeframe provided.

This includes:

  • following laboratory collection instructions;

  • providing accurate information;

  • collecting samples correctly;

  • submitting samples within the required timeframe; and

  • following any instructions provided by the laboratory.

3.5 Late or Incomplete Testing

Failure to complete or submit required testing within the specified timeframe may delay the consultation or make it necessary to reschedule.

Where a consultation must be rescheduled because required testing or samples have not been completed or submitted within the required timeframe, a £50 rescheduling fee may apply.

This fee may be waived where the delay is demonstrably caused by the laboratory or another circumstance outside the client's reasonable control.

Laboratory processing times are indicative and may vary.

3.6 Rejected or Insufficient Samples

Where a laboratory rejects a sample, determines that a sample is insufficient or is otherwise unable to process the sample, a replacement sample or repeat test may be required.

Where the issue is attributable to the laboratory or another circumstance outside the client's reasonable control, derm360º will consider the circumstances and, where appropriate, assist with arranging a replacement test.

3.7 Laboratory Providers

Laboratory testing is provided through third-party laboratory providers.

Laboratories operate under their own collection, processing and reporting procedures.

While derm360º will take reasonable care when reviewing available results, we cannot guarantee laboratory turnaround times and are not responsible for delays or errors originating from a third-party laboratory.

3.8 Test Availability

Laboratory tests are subject to availability and may change.

Where a selected test becomes unavailable, derm360º may offer an alternative test or laboratory where reasonably appropriate.

 

Where an equivalent alternative is not available, the available options will be discussed with the client.

3.7 Interpretation of Results

Laboratory results are reviewed in the context of the information available at the time of consultation.

Results are used to inform personalised wellness and skin health recommendations and do not, by themselves, constitute a medical diagnosis.

Where results indicate that medical investigation may be appropriate, you may be advised to consult your GP or another appropriately qualified healthcare professional.

3.8 Included Check-in

Where included within your service, the first check-in is included and should take place approximately 4–6 weeks after the initial consultation, unless otherwise agreed.

The included check-in is a separate appointment from the 360º consultation.

The included check-in must be completed within the 4–6 week timeframe.

Where the check-in takes place after six weeks, it will be treated as a standard follow-up consultation and charged at the current standard rate.

The included check-in is subject to the standard 48-hour cancellation and rescheduling policy.

Where at least 48 hours' notice is provided, the included check-in may be rescheduled once without charge.

 

A missed check-in appointment may be charged at 100% of the standard check-in rate.

Any additional check-ins, follow-up consultations or appointments outside the included first check-in are chargeable at the applicable standard rate.

 

The standard check-in rate is subject to change.

4. Skin Consultations & Personalised Wellness Plans

4.1 Nature of the Service

derm360º provides personalised skin health and wellness consultations informed by scientific research, biochemistry, nutritional science, client history, symptoms, lifestyle factors and, where applicable, laboratory results.

Recommendations may include nutritional, lifestyle, skincare and supplement strategies.

These recommendations are educational and wellness-focused and are intended to support skin health and general wellbeing.

4.2 No Medical Diagnosis

derm360º does not diagnose medical conditions.

Our services do not replace medical assessment, diagnosis or treatment.

Where appropriate, we may recommend that you seek assessment from your GP, dermatologist or another appropriately qualified healthcare professional.

4.3 Individual Results

Individual responses to recommendations vary.

No specific improvement, outcome or timeframe can be guaranteed.

Skin health may be influenced by numerous factors, including genetics, hormones, medications, lifestyle, environment, adherence and underlying health conditions.

In the case of adverse reactions, you must notify derm360º immediately, who will refer you to an appropriate medical professional.

4.4 Supplements & Lifestyle Recommendations

Recommendations may include dietary, lifestyle and supplement strategies.

You are responsible for ensuring that any recommendation is appropriate for your individual circumstances.

You should seek advice from an appropriate healthcare professional before making changes where you have a diagnosed medical condition, are taking medication, are pregnant or breastfeeding, or have otherwise been advised to obtain medical clearance.

4.5 Supplement Use

Supplements should be used in accordance with the instructions provided by derm360º and/or the product manufacturer.

You are responsible for checking product labels, ingredients, allergens and directions for use.

Where a supplement is purchased independently from a third party, derm360º cannot guarantee the quality, authenticity, storage or handling of that product.

If you experience an adverse reaction or significant change in your health after introducing a supplement or recommendation, discontinue use where appropriate and seek advice from a suitably qualified healthcare professional.

4.6 Product Use

Clients must follow product instructions provided by derm360º and the manufacturer.

Unless otherwise instructed, new skincare products should be patch tested before wider use.

Incorrect application, excessive use, combining products against advice, failure to follow instructions or introducing additional products may increase the risk of irritation or adverse reactions.

4.7 External Products & Treatments

Please inform derm360º before introducing significant new skincare, prescription products or professional treatments during an active plan.

Products or treatments provided by other practitioners may affect skin responses and outcomes.

derm360º cannot accept responsibility for reactions or outcomes caused by products, procedures or advice provided by another practitioner or third party.

5. Communication & Between-Appointment Support

5.1 Communication Channels

Where communication between appointments is included within a service, derm360º may use WhatsApp, email or another designated communication platform.

Communication is intended for brief questions, updates and clarification relating to an active service.

5.2 WhatsApp Support

WhatsApp support is available only to clients whose service specifically includes between-appointment support.

WhatsApp is not intended to replace a consultation.

5.3 Response Times

Messages are not monitored continuously.

Messages received outside normal business hours, on weekends, public holidays or during periods of clinic closure may be responded to during the next available business period.

While derm360º aims to respond within a reasonable timeframe, a specific response time cannot be guaranteed.

5.4 Additional Work

Requests requiring detailed assessment, interpretation of new information or laboratory results, significant changes to a plan or substantial additional work may require a chargeable consultation or check-in.

5.5 Emergencies

WhatsApp, email and other derm360º communication channels are not emergency medical services.

If you experience an urgent or serious medical problem, contact your GP, NHS 111, emergency services or an appropriate healthcare provider.

6. Online & International Clients

6.1 Online Consultations

Online consultations may be provided to clients located within or outside the UK, subject to service availability and applicable legal, regulatory and insurance requirements.

The same Terms & Conditions apply to online consultations as to equivalent services provided in person.

6.2 International Clients

Clients located outside the UK are responsible for ensuring that they are legally permitted to access and use the services, testing and products available to them in their country of residence.

Availability of laboratory testing, supplements, skincare products and other services may vary by country.

derm360º cannot guarantee that a particular laboratory test, supplement, product or recommendation will be available, permitted or suitable for use in your country.

Where a recommendation involves a product or supplement, you are responsible for checking local availability, import requirements and applicable restrictions.

6.3 Local Healthcare

Online services provided by derm360º do not replace access to local healthcare.

International clients are responsible for obtaining appropriate medical care within their own country where required.

derm360º does not provide emergency medical services or local medical treatment.

Where we believe medical assessment is appropriate, you may be advised to consult a suitably qualified healthcare professional in your country of residence.

7. Clinical & Cosmetic Treatments

Where derm360º provides clinical or cosmetic treatments, the following additional terms apply.

7.1 Eligibility

Unless otherwise stated, clinical and cosmetic treatments are available to clients aged 18 years or over.

Valid photographic identification may be requested.

We reserve the right to refuse or postpone treatment where identification cannot be provided or where treatment is not considered appropriate or safe.

7.2 Consultation & Medical Disclosure

Before treatment, you must provide accurate information regarding:

  • medical history;

  • medications;

  • allergies;

  • pregnancy or breastfeeding;

  • previous aesthetic or cosmetic treatments;

  • current skin conditions;

  • relevant medical procedures; and

  • any other information requested during consultation.

Failure to disclose relevant information may result in treatment being postponed or refused.

7.3 Suitability & Contraindications

Treatment may be postponed or refused where appropriate, including where there is:

  • pregnancy or breastfeeding where the treatment is unsuitable;

  • active infection or significant skin irritation;

  • a recent procedure requiring an appropriate recovery period;

  • a relevant medication or medical condition;

  • intoxication or impaired ability to provide informed consent; or

  • failure to follow pre-treatment instructions.

7.4 Risks & Results

Clinical and cosmetic treatments carry potential risks and side effects.

Depending on the treatment, these may include redness, swelling, tenderness, bruising, irritation, infection, allergic reaction and other temporary or prolonged effects.

Results vary between individuals and cannot be guaranteed.

7.5 Aftercare

Clients are responsible for following all pre-treatment and aftercare instructions provided by derm360º.

Failure to follow aftercare instructions, introducing unsuitable external products or treatments, or undertaking activities contrary to advice may affect healing and results.

7.6 Reviews & Further Treatment

Where appropriate, review appointments may be recommended.

A review does not automatically entitle a client to additional treatment without fee.

Additional treatment requested for aesthetic preference rather than correction of an identified issue may be chargeable.

7.7 Treatment Refunds

Completed treatments are non-refundable simply because a client is dissatisfied with the result or subsequently changes their mind.

Where a concern arises, please contact derm360º so that the matter can be assessed and, where appropriate, addressed.

Nothing in these Terms & Conditions limits your statutory consumer rights.

6. Clinical Photography & Records

Clinical photographs may be required as part of assessment, treatment planning, progress monitoring, professional documentation and, where applicable, insurance requirements.

Where photographs are required for clinical, professional or legal purposes, they form part of your clinical record.

Marketing consent can be withdrawn at any time. Withdrawal does not affect use that has already occurred lawfully before consent was withdrawn.

7. Privacy & Personal Information

Personal and clinical information will be collected and processed in accordance with applicable UK data protection legislation and our Privacy Policy.

Information may be used for purposes including:

  • providing and managing your services;

  • maintaining appropriate records;

  • communicating with you;

  • coordinating laboratory testing;

  • treatment and wellness planning;

  • reviewing progress; and

  • meeting legal, regulatory and insurance requirements.

We take reasonable steps to protect personal information. However, we cannot guarantee the security of information transmitted through third-party platforms or systems outside our reasonable control.

Please refer to our Privacy Policy for further information about how your personal information is collected, used and stored.

8. Records

Records relating to consultations, recommendations, testing and treatments will be retained for the period considered appropriate by derm360º, taking into account applicable legal, regulatory, professional and insurance requirements.

Where a specific retention period applies, this will be communicated where appropriate.

Clients may have rights in relation to their personal information under applicable data protection legislation. Further information is provided in our Privacy Policy.

9. Intellectual Property & Personalised Plans

9.1 Ownership

All materials provided by derm360º remain the intellectual property of derm360º or the relevant rights holder unless otherwise stated.

 

This includes, but is not limited to:

  • personalised plans and protocols;

  • written recommendations;

  • educational materials;

  • guides and resources;

  • worksheets;

  • templates;

  • testing frameworks;

  • website content;

  • photographs and graphics; and

  • proprietary methods, processes and materials.

9.2 Personal Use

Materials supplied as part of a service are provided for the individual client's personal use only.

They must not be copied, reproduced, published, distributed, resold, commercially exploited or shared with third parties without prior written permission from derm360º.

Personalised recommendations are prepared specifically for the individual client and should not be applied to another person.

9.3 Healthcare Professionals

Nothing in this section prevents a client from sharing relevant information or recommendations with their GP, pharmacist or other healthcare professional where reasonably necessary for their own care.

10. Consultation Recording

10.1 Recording by Clients

Clients must not record, reproduce, livestream or distribute any in-person or online consultation without the prior consent of derm360º.

 

Where permission to record is granted, the recording must be used solely for the client's personal reference and must not be published, distributed, sold or shared publicly without written permission.

10.2 Recording by derm360º

Where derm360º records a consultation for training, quality assurance, documentation or other purposes, this will only be undertaken where appropriate notice and any required consent has been provided.

Any recording will be handled in accordance with applicable data protection requirements.

11. Service & Programme Timeframes

11.1 Programme Timeframes

Where a service or programme includes a defined timeframe, appointments, check-ins, testing and support should be completed within the timeframe specified at the point of purchase.

11.2 Included Appointments

Included appointments, check-ins or support cannot automatically be carried forward indefinitely where the client chooses not to engage within the applicable timeframe.

Where an included appointment falls outside the specified timeframe, it may become chargeable at the applicable standard rate.

11.3 Client Delays

Where a delay is caused by the client, including failure to complete testing, submit samples, attend appointments or provide requested information, the original service timeframe may no longer apply.

Any extension or continuation will be considered at derm360º's discretion and may incur additional fees.

12. Client Conduct

derm360º is committed to maintaining a safe, respectful and professional environment.

We do not tolerate abusive, threatening, aggressive, discriminatory or inappropriate behaviour towards derm360º, its practitioners, staff, contractors or third-party providers.

Where necessary, we may terminate a service or refuse future bookings.

Any outstanding payment remains payable where services have already been provided or where the cancellation falls within the applicable cancellation terms.

13. Payment Disputes

13.1 Payment Concerns

If you believe a payment has been made in error or there is a concern regarding an invoice or charge, please contact derm360º directly so that the matter can be reviewed.

13.2 Chargebacks

Clients should contact derm360º before initiating a payment dispute or chargeback where the concern can reasonably be resolved directly.

Where a chargeback is initiated for a legitimate outstanding balance or a service that has been provided in accordance with these Terms & Conditions, derm360º reserves the right to provide relevant booking, payment and service records to the payment provider as part of the dispute process.

Nothing in this section limits your statutory consumer rights.

14. Complaints

14.1 Raising a Complaint

If you have a concern about a service, please contact derm360º as soon as reasonably possible.

Complaints should be submitted in writing and should include sufficient information for us to understand the concern, including the relevant service, appointment date and details of the issue.

14.2 Review of Complaints

We will review complaints fairly and objectively and may request additional information where necessary.

We aim to acknowledge complaints within a reasonable timeframe and will provide a substantive response as soon as reasonably practicable.

14.3 Resolution

Where appropriate, derm360º may offer clarification, further information, corrective action or another reasonable resolution.

A complaint does not automatically entitle a client to a refund or additional treatment.

Any refund or remedy will be considered based on the circumstances, the service provided and applicable consumer law.

14.4 Further Action

If a complaint cannot be resolved directly, you retain any rights available to you under applicable UK consumer law.

15. £10 Review Voucher

Where a £10 voucher is offered in connection with a Google review:

  • the voucher may be redeemed once;

  • a minimum purchase value of £100 applies;

  • proof of the qualifying review may be required;

  • the voucher cannot be exchanged for cash;

  • it cannot be combined with other offers unless expressly stated;

  • derm360º reserves the right to amend or withdraw the offer where permitted by law.

Any review must reflect the client's genuine experience.

16. Refunds

Where a refund is due, it will normally be processed to the original payment method.

Refund processing may take 7–14 days, depending on the payment provider and banking system.

Refund terms for individual services are set out within these Terms & Conditions and may also be specified at the point of booking.

Nothing within these Terms & Conditions removes or restricts any rights you have under applicable UK consumer law.

17. Liability

derm360º will provide its services with reasonable care and skill.

To the extent permitted by law, derm360º is not responsible for outcomes arising from:

  • inaccurate or incomplete information supplied by a client;

  • failure to disclose relevant information;

  • failure to follow recommendations, product instructions or aftercare;

  • misuse of products;

  • products, treatments or advice provided by third parties;

  • failure to seek appropriate medical care where recommended;

  • laboratory delays or errors outside our reasonable control; or

  • circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

18. Changes to These Terms & Conditions

18.1 Updates

derm360º may update these Terms & Conditions from time to time to reflect changes to our services, business operations, legal requirements or professional practices.

The most recent version will be published on our website together with the date it was last updated.

18.2 Existing Bookings

Unless required by law, changes to these Terms & Conditions will not retrospectively alter the terms of a booking that has already been confirmed.

The version applicable to a booking will generally be the version in force at the time the booking was confirmed.

18.3 New Bookings

By making a new booking or purchasing a further service after updated Terms & Conditions have been published, you agree to the version applicable at that time.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Subject to applicable consumer rights, the courts of England and Wales will have jurisdiction over disputes arising in connection with these Terms & Conditions.
